General Terms and Conditions (GTC)

for the rental of holiday apartments

1. Scope, Provider, Nature of the Contract

(1) These General Terms and Conditions apply to all contracts for the short-term

rental of holiday apartments in Villa Hedwig, Römerstraße 10, 79410 Badenweiler,

by Catapult Immo GmbH.

(2) The contracting party is the person making the booking (“guest”).

(3) This is a sui generis accommodation contract pursuant to Sections 535 et seq. of the German Civil Code (BGB).

2. Conclusion of Contract

(1) The presentation of the holiday apartments does not constitute a binding offer.

(2) The contract is only concluded upon written booking confirmation.

(3) The landlord is entitled to refuse bookings without giving reasons.

3. Payment Terms

(1) The total price is due immediately upon conclusion of the contract.

(2) The landlord is entitled to demand 100% prepayment.

(3) In case of late payment, the landlord may withdraw from the contract and claim damages.

4. Security Deposit

(1) The landlord may require a reasonable security deposit.

(2) The security deposit serves as security for all claims.

(3) Refund within 14 days of departure, less any justified charges.

5. Arrival and Departure / Self-Check-in

(1) Arrival is via electronic self-check-in.

(2) Access data must be kept confidential.

(3) Departure is no later than 10:00 a.m.

(4) In case of late return, a usage fee of at least one day’s rent will be charged.

6. Cancellation Policy

Up to 30 days before arrival: 50%

Up to 14 days before arrival: 80%

From 13 days before arrival or no-show: 100% of the total price.

The guest reserves the right to prove that the actual damage incurred was less.

7. Occupancy and Penalty Clause

(1) Occupancy is limited to the number of persons booked.

(2) Penalty clause for over-occupancy: EUR 250 per person per night.

(3) Events are prohibited.

8. Pets

Pets are allowed. The guest is liable for all damages and special cleaning costs.

9. Cleaning and No Smoking

(1) In case of exceptional soiling, a minimum additional cleaning fee of EUR 150 will be charged.

(2) Smoking is prohibited in all indoor areas. A minimum fee of EUR 250 will be charged for violations.

10. Parking

Parking is at your own risk. There is no guarantee of a specific parking space.

11 Liability

(1) Unlimited liability in cases of intent, gross negligence, and personal injury.

(2) Otherwise, liability is limited to typical contractual damages.

(3) No guarantee is given for Wi-Fi availability.

12 Lost Keys

The guest bears all costs in the event of lost keys or access systems.

13 Data Protection and Video Surveillance

Outdoor areas may be under video surveillance. A separate data protection declaration applies.

14 Statute of Limitations and Jurisdiction

(1) Claims by the guest become time-barred within one year, to the extent permitted by law.

(2) The place of jurisdiction is – to the extent permitted by law – the registered office of Catapult Immo GmbH.

(3) German law applies.
